ILLEGAL!
« on: April 24, 2008, 09:24:11 AM »
So, I was told by a fairly unreliable source that I am unable by law to place a 4-10x scope and a bipod on my M1A. He claimed that those items would make my weapon illegal to own as a civilian.

Now, I chose to not believe this, but it sounds like a rule that ATF would want.

Is it true?

If you can legally possess and purchase the components then what law could possibly make the combination illegal?

Anytime someone tells you "that's illegal" immediatly require them to provide you with a citiation to the specific statute that makes it illegal.  If they are so certain its illegal they should know the statute or where to find it.

Say an MP5k (civilian pistol version) and an MP5 stock?  The stock would make it an SBR rather than a pistol.  Correct me if I am wrong (probably am) but doesn't ATF consider that intent to build?

with the mp5k, the stock doesn't make it a SBR, it's just a pistol with a stock.

Don't EVER give anybody advice that they will use in this regard. ;)

You would have just cost your friend dearly if the ATF got involved.

And that now is classified as an SBR...

the ATF isn't the LAW.  The United States Code is the law.  Sometimes the Code allows the agency to establish regulations but violation of a regulation is not typically a crime.

To be a criminal act there has to first be a statute or code that makes the act a crime.

So if you are going to aver a crime you should be able to first reference that statute or code.  Otherwise its nothing more than bullshit and uneducated opinion.

In my educated opinion......

As far as I know (thought what exactly do I know) a silencer is the only thing thats illegal to a civilian.

Clearly now proven wrong

(sorry for the very poor attempt at humor)

Doc, Vince - Backcheck me on this...

As far as I can remember Silencers, Destructive Devices (missile launchers, Claymores, etc) and Automatic Weapons all fall under the ATFE regulations and are legal to own as long as you pay the appropriate Licence fee and tax - read thatMordita
